Betancourt v. Trinitas - Certification to the Supreme Court

In today's New Jersey Law Journal, Charles Toutant reports that "the hospital says it not ruling out seeking certification before the state Supreme Court."  


There is no appeal as of right because there was no dissent in the Appellate Division.  A petition for certification involves "discretionary review," which means that the New Jersey Supreme Court does not have to hear the case.  Under Rule 2:12-3(a), Trinitas Hospital has twenty days from the date of the Appellate Division decision to file a "petition for certification" with the Supreme Court.  That means a petition for cert. must be filed by September 2, 2010
